Louisiana is among only a handful of states to use the “community property” model of asset division. This essentially means that any property acquired by either party during the marriage is considered jointly owned (with few exceptions). This also typically applies to assets that increased in value during the marriage.
Property acquired by either party before marriage is considered separate property. If either spouse receives a gift or inheritance intended solely for them during the marriage, that is also likely to be deemed separate property.
Community property is subject to division in divorce, while separate property is not. Under state law, jointly owned property could be split 50-50, but it doesn’t necessarily have to be if there is a valid prenuptial agreement in place or if either the couple or the courts decide to deviate from an even split.
