Finding Effective Divorce Solutions Without a Courtroom Battle
If you are contemplating or currently involved in a divorce, it can be a stressful, even overwhelming, time. You have many important decisions to make and the outcome of your choices will have long-lasting effects for all involved. It is important to understand and protect your rights and do what is best for you and your children.
At The Law Office of Camille Saltz Babin, I have over 15 years of experience guiding clients in Terrebonne Parish and throughout southeast Louisiana through the divorce process. I place an emphasis on finding cooperative and productive solutions that effectively address your needs.
I am focused on finding productive outcomes that minimize the emotional impact of divorce whenever possible. Call 985-580-7796 or contact me online to discuss your situation.
My Approach to Divorce
When you come to me for legal advice in your divorce, I will take the time to understand the facts of your situation and your goals. I will explain Louisiana's divorce process, how the community property laws work and provide you a realistic assessment of what you can expect. We will discuss all your legal options and formulate the approach that will meet your goals most effectively.
Most of the time, divorce and related issues such as child custody and support, are made in a settlement conference with both parties and their lawyers. I have an extensive background in alternative dispute resolution. As a qualified family law mediator and a member of the Collaborative Professional Group of Southwest Louisiana, I help my clients arrive at agreements without a lengthy and expensive courtroom fight whenever possible.
Methods like mediation, which is basically a facilitated negotiation, and collaborative divorce allow couples to make their own decisions tailored to their individual situation. Collaborative law takes a team-based approach to divorce, where the divorcing spouses, along with their attorneys, a counselor and financial advisor, work together to arrive at a solution that each can accept. Less costly, time-consuming and adversarial than traditional litigation, these methods can minimize the emotional impact of divorce on the parties, including the children.
If however, a reasonable agreement cannot be achieved, I stand ready to protect your best interests in the courtroom through litigation.
No-Fault Divorce in Louisiana
Although you can allege fault to get an immediate divorce if your spouse has committed adultery or has been convicted of a felony, most of my clients file for no-fault divorce in Louisiana. Spouses must live separately for a period of time before being granted a divorce. You have the choice to live separately for a certain period of time and then file, or you can file for divorce and then live separately. The timing of your filing will affect the division of property and child or spousal support orders. I will help you decide which option makes the most sense for your circumstances.
Community Property
In Louisiana, property division is determined by the rules of community property. This means that marital assets and debts will generally be split evenly between both parties, unless a prenuptial or postnuptial agreement modifies this rule. Determining whether property, assets and debts are community or separate is important, and I will help you understand how property division rules will affect your situation.
